Terms of Service
Version 1.0 — effective July 14, 2026
These Terms of Service ("Terms") govern your access to and use of the swaudit website at swaudit.net, the hosted swaudit audit service, demo and interactive sandbox sessions, and related APIs (together, the "Service"), operated by swaudit ("we," "us"). By accessing or using the Service, you agree to these Terms and to the swaudit Acceptable Use Policy (the "AUP"), which is incorporated by reference. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization, and "you" refers to it.
If you have a separately signed agreement with us (for example, a commercial license, order form, or master services agreement), that agreement controls where it conflicts with these Terms. The self-hosted distribution of the swaudit software is governed by its source-available license, not these Terms; these Terms govern the hosted Service and website.
1. The Service
swaudit is a dynamic-analysis platform: it executes candidate software ("Submissions") inside an instrumented sandbox and produces a report describing behavior observed during the run, together with a recommended decision (REJECT / REVIEW / APPROVE) and supporting evidence ("Reports").
2. Access, accounts, and tokens
Access to gated features is provided via credentials such as single-sign-on identities, access tokens, demo tokens, or PINs ("Credentials"). You are responsible for keeping Credentials confidential and for all activity under them. Demo tokens are provided for evaluation only, may be single-use or limited-use, and may be revoked at any time. We may suspend or terminate access to protect the Service or other users.
3. Demo and interactive sessions
Demo and interactive sandbox sessions are provided for evaluation. Sessions are time-limited, resource-limited, and monitored; session activity — including executed processes, file and network activity, intercepted network traffic of the candidate software, and screen output — is recorded and used to produce Reports and to operate and secure the Service, as described in the Privacy Policy. We may terminate any session at any time.
4. Submissions — your representations
For every Submission you provide (an uploaded binary, package, container image, URL, or your selection of software for analysis), you represent and warrant that:
- you have the legal right to possess the Submission and to have it executed, instrumented, and analyzed by the Service, including under any license or agreement covering the Submission;
- the Submission and your use of the Service comply with applicable law and the AUP;
- the Submission does not contain unlawful content, or personal data you are not permitted to share with us; and
- where the Submission is third-party software, your analysis of it is authorized — for example, as security research, pre-procurement evaluation, or under license terms permitting it.
You retain all rights in your Submissions. You grant us a non-exclusive license to execute, instrument, analyze, copy, and process Submissions solely to provide the Service, produce Reports, and operate, secure, and improve the Service.
5. Reports — nature and limits
Reports document behavior observed during a specific run, in a specific sandbox environment, during a stated run window. You acknowledge and agree that:
- a Report is evidence to support your organization's own decision-making; it is not a certification, endorsement, or guarantee of any software's safety, quality, or fitness;
- absence of a finding is not proof of absence — malicious or unwanted behavior may be dormant, environment-dependent, time-delayed, or outside the instrumentation's coverage;
- the REJECT / REVIEW / APPROVE line is a recommendation generated from observed evidence and configured policy, and the decision whether to approve, deploy, or use any software is solely yours;
- Reports may contain false positives and false negatives; and
- Reports describe observed behavior of third-party software and do not represent any affiliation with, or statement of opinion about, the software's vendor beyond the recorded observations.
Reports we produce for you are yours to use internally. Public distribution of a Report naming third-party software is at your own risk and responsibility.
6. Acceptable use
You will comply with the AUP. In summary (the AUP controls): analyze only software you are authorized to analyze; do not use the Service or its sandboxes to attack, scan, or harm third parties, or to host or distribute malware; do not attempt to escape the sandbox or interfere with the Service or other tenants; do not circumvent session, rate, or resource limits; do not misrepresent, alter, or forge Reports or their signatures.
7. Intellectual property; feedback
We and our licensors own the Service, the swaudit software, and the Report formats, templates, and signing infrastructure. These Terms grant you no rights in them except the limited right to use the Service. If you provide feedback or suggestions, you grant us a perpetual, irrevocable, royalty-free license to use them without restriction.
8. Data
Our Privacy Policy describes what we collect and how we handle it. Self-hosted deployments keep all data on your own infrastructure.
9. Third-party services
The Service can send data to integrations you configure (for example Slack, Jira, or webhooks). Your use of those services is governed by their terms, and you are responsible for what you configure the Service to send to them.
10. Disclaimers
THE SERVICE AND ALL REPORTS ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, OR THAT THE SERVICE WILL DETECT ANY OR ALL MALICIOUS, VULNERABLE, OR UNWANTED BEHAVIOR IN ANY SUBMISSION. WE DO NOT WARRANT UNINTERRUPTED OR ERROR-FREE OPERATION.
11. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW: (a) NEITHER PARTY IS LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR LOST PROFITS, REVENUE, DATA, OR GOODWILL; AND (b) OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS IS LIMITED TO THE GREATER OF (i) THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO LIABILITY AND (ii) ONE HUNDRED U.S. DOLLARS (US $100). WITHOUT LIMITING THE FOREGOING, WE HAVE NO LIABILITY FOR ANY DECISION YOU OR ANY THIRD PARTY MAKES IN RELIANCE ON A REPORT, INCLUDING A DECISION TO APPROVE, DEPLOY, OR CONTINUE USING ANY SOFTWARE.
12. Indemnification
You will defend and indemnify us against third-party claims arising from: (a) your Submissions, including any claim that analysis of a Submission was unauthorized; (b) your breach of Section 4 or the AUP; or (c) your public distribution of a Report.
13. Termination
You may stop using the Service at any time. We may suspend or terminate your access immediately for breach of these Terms or the AUP, or where required to protect the Service, other users, or third parties. Sections 4, 5, 7, and 10 through 15 survive termination.
14. Changes
We may update these Terms; material changes will be posted on this page with an updated effective date, and continued use after the effective date constitutes acceptance. We may change or discontinue features of the Service at any time.
15. General
If any provision of these Terms is held unenforceable, the remaining provisions stay in effect. Our failure to enforce a provision is not a waiver. These Terms, the AUP, and the Privacy Policy are the entire agreement between you and us about the Service, unless superseded by a signed agreement.
